Limited Warranty

The Pine Tree Filter Company (PTFC) warrants to the

original purchaser only that the PTFC Travel Filter product will be

free from defects in material and workmanship under normal use

and in accordance with the instructions in the applicable published

product documentation, and will conform and operate as described

in this documentation in all material respects during the Limited

Warranty Period.

To obtain coverage under this Limited Warranty, Purchaser must

make a claim in writing to PTFC during the Warranty Period,

which must include proof of purchase of the PTFC Travel Filter

product, a description of the nature of the defect in sufficient detail

for PTFC to locate and recreate the defect, and an inspection by

PTFC must prove the claim to its satisfaction.

PTFC’s sole and exclusive obligations under this Limited

Warranty, if Purchaser properly notifies PTFC of a warranty claim

during the Warranty Period and if, after its inspection, PTFC

agrees the Travel Filter product is in breach of the Limited Product

Warranty, shall be limited to the repair of the PTFC Travel Filter

product or replacement with an equivalent product, at PTFC’s

sole option, or a refund of the amount paid for any defective PTFC

Travel Filter product, subject to the further exclusions set forth in this

Limited Warranty.

PTFC’s obligation as to replacement of the PTFC Travel Filter

product shall further be limited to replacement with an equivalent

Travel Filter product in the styles that are available at the time of the

warranty claim.

PTFC’s obligation as to a refund shall be further limited only to

instances where PTFC in its sole judgment determines that it is

unable to correct the defect or replace the Travel Filter product with

an equivalent or comparable Travel Filter product.

Disclaimer of Warranties

The PTFC Travel Filter product must be stored, handled, installed,

used, and maintained in accordance with the product documentation

and instructions provided by PTFC, and this Limited Warranty is

conditioned upon compliance with all such documentation and

instructions. Copies of PTFC’s product documentation and

instructions are available from PTFC at the address listed below.

This Limited Warranty does not apply to commercial use and is

extended to the original purchaser only. This Limited Warranty is

personal to the purchaser and may not be transferred or assigned to

a third party.

 

This Limited Warranty shall not apply to this PTFC Travel Product

or any part thereof which has been subject to accident, negligence,

alteration, abuse, unreasonable or unintended use, misuse,

improper storage, mishandling, misapplication, damage not resulting

from manufacturing defects that occur while the Travel Filter product

is in the Purchaser’s possession, improperly performed adjustments

or repairs, dissatisfaction with the product appearance, or failure to

follow product documentation.

THIS LIMITED WARRANTY AS SET FORTH HEREIN IS THE

ONLY WARRANTY MADE BY PTFC TO CUSTOMERS IN

CONNECTION WITH THE PTFC TRAVEL FILTER PRODUCT.

EXCEPT FOR THIS LIMITED WARRANTY, PTFC CAN NOT

AND DOES NOT MAKE ANY IMPLIED OR EXPRESS

WARRANTIES WITH RESPECT TO THE PTFC TRAVEL FILTER

PRODUCT, AND DISCLAIMS ALL OTHER WARRANTIES,

INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF

MERCHANTABILITY OR FITNESS FOR A PARTICULAR

PURPOSE. PRODUCTS SOLD BY PTWFC ARE SOLD ONLY TO

THE SPECIFICATIONS SPECIFICALLY SET FORTH BY PTFC

IN WRITING. OTHER THAN THE LIMITED WARRANTY SET

FORTH HEREIN, PTFC MAKES NO OTHER WARRANTIES,

EXPRESS OR IMPLIED. PTFC’S SOLE OBLIGATION UNDER

THIS WARRANTY SHALL BE REPAIR OR REPLACEMENT OF

NON-CONFORMING PRODUCTS, OR AT THE OPTION OF

PTFC, RETURN OF THE PRODUCT AND A REFUND OF THE

PURCHASE PRICE. BUYER ASSUMES ALL RISK

WHATSOEVER AS TO THE RESULT OF THE USE OF THE

PTFC TRAVEL FILTER PRODUCT PURCHASED, WHETHER

USED SINGULARLY OR IN COMBINATION WITH ANY OTHER

PRODUCTS OR SUBSTANCES.

Limitation of Liability

No claim by the Purchaser of any kind, including claims for

indemnification, shall be greater in amount than the purchase price

of the PTFC Travel Filter product in respect to which damages are

claimed. IN NO EVENT SHALL PTFC BE LIABLE TO THE

PURCHASER IN TORT, CONTRACT OR OTHERWISE, FOR ANY

SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL,

RELIANCE, STATUTORY, SPECIAL, PUNITIVE OR EXEMPLARY

DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS,

LOSS OF USE, LOSS OF TIME, LOSS OF REVENUES,

INCONVENIENCE, LOSS BUSINESS OPPORTUNITIES, DAMAGE

TO GOOD WILL OR REPUTATION, OR LOSS OF DATA, EVEN IF

ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH

DAMAGES COULD HAVE BEEN REASONABLY FORESEEN, IN

CONNECTION WITH, ARISING OUT OF, OR AS A RESULT OF,

THE SALE, DELIVERY, SERVICING, USE OR LOSS OF USE OF

THE PRODUCTS SOLD HEREUNDER, OR FOR ANY LIABILITY

OF PURCHASER TO ANY THIRD PARTY WITH RESPECT

THERETO.
